Novartis Pharmaceuticals can get in line with the rest of the people accusing Kanye West of infringing on their copyrights. The cold medicine maker has said they do not endorse Kanye's use of their brand for his new song Theraflu, wherein Kanye professes his love for Kim Kardashian...
A company rep tells TMZ, "We in no way endorse or approve of the references or use of the image and likeness of Theraflu in this manner."
Theraflu reps did not say they would sue the singer, but their statement includes buzz words -- image and likeness -- that are often used in legal proceedings.
In the statement, the Theraflu rep adds, "Theraflu is an over-the-counter product used to help relieve cold and flu symptoms that millions of consumers rely on."

If this in fact does reach court the decision will set a precedent because products are always mentioned in songs and some even have product Names. You see Mercedes (Maybach) suing Rick Ross? That because he is. I'm sure Theraflu is financing his project in some shape or form in exchange for Kanye advertising. The whole thing plays into Ye's IDGAF bad boy image. And Theraflu is tapping into a demographic they may have not had before.
Remember children, Hollywood is all an illusion, just smoke and mirrors set into place by overarching contracts, some signed in blood, of you know what I mean.
Rappers use NyQuil in their songs a lot, and it's usually referenced in a negative manner, like getting high off of it or mixing it with liquor. You never see NyQuil stepping in using threatening words. This just might be a business venture between the two brands: Theraflu/Kanye West.
Theraflu can sue if they want, and will win. why, because its a registered trade mark. mentioning a product in a song does not get the lawers barking at your door as much as making it the title to your song. people can theorize to the cows come home but if they decide to sue, all he can do is bend over and take it.
