Cardi B Disputes False Imprisonment in Civil Suit


Four years ago rapper Cardi B was sued by a security guard at her OBGYN's office who accused Cardi of calling her racial slurs after refusing to take a picture with her [click here if you missed that]. 

The lawsuit is dragging on as Cardi asks that several claims be dismissed...

Cardi B fought to have multiple claims in the lawsuit filed by a security guard over an alleged medical office beatdown be thrown out ahead of the upcoming trial.
According to court documents obtained by RadarOnline.com, the Bodak Yellow rapper asked a Los Angeles Superior Court judge to dismiss the claim of false imprisonment and another claim that accused her of violating the Bane Act.
The Bane Act is a "California law that prohibits people from using force or threats of violence to interfere with a person's constitutional rights."
As RadarOnline.com previously reported, Cardi was sued by a female security guard named Emani Ellis.
In her lawsuit, Ellis claimed she saw Cardi leaving a medical office while she worked her shift. She claimed to have approached the musician for a photo but was turned down.
At the time, Cardi was pregnant with her daughter Kulture but had yet to reveal the news to the world.
Ellis claimed to have exchanged words with Cardi over her refusal to take the selfie. In court documents, Ellis accused Cardi of striking her in the head, face, and body.
Ellis claimed Cardi spit on her and used “multiple profanities and racial slurs against [Ellis] who is African American.”
The security guard claimed she was fired from her job after Cardi used her “celebrity status” and made calls to the building owners. A rep for the medical building denied the claim to TMZ.
The lawsuit demanded unspecified damages for the alleged assault. Cardi denied all allegations of wrongdoing.
The trial is scheduled to start on February 1. In her recent motion, Cardi asked the judge to dismiss the claim of false imprisonment due to it being filed past the statute of limitations.
Cardi argued the claim should have been brought 1-year after the alleged February 2018 incident — but said Ellis didn’t file the lawsuit until February 2020.
As a result, she argued the false imprisonment claim should be thrown out before the trial.
Regarding the other claim she asked to be dismissed, Cardi's lawyer said Ellis argued the entertainer “somehow interfered with [Ellis’] constitutional right to engage in legitimate employment. [Ellis], however, fails to show how [Cardi], an entertainment celebrity and not a state actor, was legally capable of violating any constitutional rights.”
A judge has yet to rule.
As we first reported, recently, Cardi asked the court to not allow testimony about her net worth to be used as evidence and for any talk of past altercations with third parties not to be mentioned.

CARDI IS DOING THE SAME THING NOW TO A WOMAN WHO MADE A TIK TOCK COMMENT THAT CARDI DIDN'T LIKE! Cardi threatened the girls life and got her fired from her job. Listen people.... leave this bird alone. DON'T POST STORIES OR COMMENT ON HER. LET HER CAREER DIE OUT!!

That was a MEDICAL facility. That security guard had absolutely NO reason for asking her for a picture or autograph and if she said “no” that was her right. Cardi didn’t want the world to know about her pregnancy at that time, and that was her right, and the guard blatantly disregarded that. She deserved to be fired. You don’t bother people when they at medical care facilities that’s just COMMON SENSE. Imagine if somebody went up to Rhianna or Beyonce when she pregnant with the twins before she announced it wanted a picture and autograph and she just got done with a sonogram, or wanting a picture or autograph with Brittany Spears or Kanye while they were on their 5150 holds , that is ridiculous . The entitlement of these fans is BEYOND STUPID 💯

@3:05 A MEDICAL FACILITY is not considered public. That’s why paparazzi stops at the driveways and you don’t have pictures of celebs going in for plastic surgery, surgery or doctor appointments. That’s a FELONY according to Federal Stalking Laws. Stalking 18 USCS § 2261A. You can NOT bother/engage with anyone, yourself included, not just celebrities. Once someone is on MEDICAL grounds. It is against FEDERAL laws. 💯

@3:05 That is just dumb. Stars don't belong to you in their "free time". Don't ever approach people just because they're public personalities some of the time. They are equally private personalities and they should be able to go about their business unbothered.

@7:11 because EVERYONE deserves privacy at a medical facility celebrity or no celebrity, including you and me and what that guard did was flat out wrong, and she knew better. Why are people defending someone who valued an autograph and picture from a star over breaking the rules and law, and put her job at risk for bragging rights??? That job feeds her family, Cardi doesn’t. We ALL DESERVE PRIVACY when we are dealing with matters of our healthcare. That guard crossed the line and threw her own job away 🎯

Anybody who works in healthcare in that building from security to the janitor to the parking attendant knows not pull over ANY patients for nonessential/non emergency reasons, especially not for an autograph/picture, and it’s wrong and illegal. It doesn’t matter to me if this was Cardi, or Kanye, or Beyonce …I’M DEFENDING PATIENT RIGHTS and COMMON SENSE 💯
